    nel ringraziarti per l’interessamento per le Applicazioni MIC-FI (Mic-Fi / Mic-Fi Plus 2 / Mic-Fi Med Plus / Mic-Fi Beauty / Mic-Fi Medical) ti informiamo che in questa pagina potrai trovare le informazioni che disciplinano l’utilizzo di queste applicazioni (di seguito indicate anche come “APP”) da parte di ITALECO S.r.l. – C.F. / P.IVA 06539670015 con sede legale in Via PAVIA n.105/i, CAP 10098 Rivoli (TO) ITALY (di seguito anche solo come “Società”)

    A CHI SI RIVOLGE – DESTINATARI/UTILIZZATORI

    Le APP sono riservate agli utenti che abbiano compiuto almeno i 14 anni. Al di sotto di questa soglia di età gli utilizzatori saranno soggetti alla tutela e vigilanza dei propri genitori/tutori. Pertanto, invitiamo coloro che non siano ancora in possesso di tale età anagrafica a non scaricarla, e coloro che abbiano meno degli anni 18 a farsi assistere dai propri genitori / tutori (di seguito anche solo “utente/i” qualora si verificasse tale eventualità).

     

     

    CARATTERISTICHE DEL PRODOTTO

    Le principali caratteristiche delle APP Mic-Fi sono quelle di acquisire foto e video e per le APP MED PLUS / MEDICAL e BEAUTY vi è in più la possibilità di inserire il nome del paziente/cliente per una catalogazione delle foto.

     

     

    INSTALLAZIONE – DOWNLOAD

    Sin dal download e l’installazione dell’App sul proprio dispositivo, il singolo utente dichiara di accettare i presenti Termini di servizio e d’uso nonché la privacy policy disponibile al seguente link https://mic-fi.it/elementor-6066/.

    I termini d’uso e Privacy Policy sono disponibili nella loro versione più aggiornata.

     

    Le APP non prevedono forme di autenticazione/registrazione, ma possono raccogliere dati personali dei utenti/clienti/pazienti inseriti dai medesimi cd “utilizzatori” delle APP. Dati che saranno gestiti soltanto dai medesimi. Le APP Mic-Fi lavorano e sono archiviate solo in locale sul device (scelto) dell’utilizzatore.

    Nel caso in cui gli utenti abbiano effettuato l’acquisto di una APP Mic-Fi, questi vengono considerati “Utenti/Consumatori”, (indicati di seguito anche come “Clienti” o “Acquirenti”) intesi quali persone fisiche che, in relazione all’acquisto dei Prodotti (microscopi), agiscano per scopi estranei all’attività imprenditoriale, commerciale, artigianale o professionale eventualmente svolta.     Il download delle APP è disponibile su App Store – Apple e Google Play Store; l’utilizzo delle APP è riservata esclusivamente all’Utente, e non potrà essere ceduta a terzi.

    Non sono previste forme di autenticazione alcuna.

    Segnaliamo che i sistemi informatici e le procedure software preposte al funzionamento della App acquisiscono, nel corso del loro normale esercizio, alcuni dati comunque riferibili all’Utente la cui trasmissione è implicita nell’uso dei protocolli di comunicazione internet, degli smartphones e dei dispositivi utilizzati. In questa categoria di dati rientrano, a titolo esemplificativo ma non esaustivo, la posizione geografica, l’identità del telefono, i contatti dell’Utente, e-mail, i dati relativi alla carta di credito.

    In qualsiasi momento, tuttavia, l’utilizzatore potrà disinstallare dal proprio dispositivo l’App scaricata.

     

    FUNZIONALITÀ

    Gli utenti una volta scaricata e installata l’APP, questa sarà “in locale” e quindi allocata direttamente sul proprio dispositivo (tablet o smartphone). L’APP non è supportata da alcun server remoto. L’accesso deve avvenire tramite una connessione “wifi”.

    L’APP consente:

    • di scattare foto e registrare video (al fine di interfacciarsi con il sistema operativo del device in cui è per l’immagazzinamento di foto e video);

    • l’accesso a foto e video sul dispositivo (al fine di interfacciarsi con il sistema operativo per l’immagazzinamento di foto e video);

    • l’accesso alla cartella ai file multimediale/audio sul dispositivo (al fine di interfacciarsi con il sistema operativo per ottenere il suono dello scatto della foto);

    • Accesso alla geolocalizzazione (al fine di poter usare lo strumento Mic-Fi)

     

    L’APP è utilizzabile solo dagli acquirenti/possessori di un dispositivo Mic-Fi.

     

    UTILIZZO – DIVIETI E CONSEGUENZE

    Poiché l’utilizzo delle App è riservato soltanto agli utenti che abbiano compiuto almeno 14 anni, coloro che non fossero ancora in possesso di tale età anagrafica li invitiamo a non registrarsi. Mentre i minori tra i 14 e 18 anni dovranno farsi assistere dai propri genitori / tutori.

    È fatto divieto all’Utente di utilizzare l’App per compiere azioni illecite. La Società si riserva la facoltà di agire in giudizio per far valere i propri diritti, qualora dovesse accertare il verificarsi dei suddetti eventi. In nessun caso il Cliente potrà alterare, cambiare, modificare o adattare le APP, né il materiale eventualmente messo a disposizione dalla Società.

     

    PROPRIETÀ INTELLETTUALE

    Le applicazioni Mic-Fi sono soggetti al Copyright. Tutti i diritti sono riservati. Le App sono protetto dalle leggi sul copyright e dalle disposizioni dei trattati internazionali applicabili. Le App non possono essere copiate, decompilate, retroanalizzate, disassemblate o ridotte in qualunque altro modo in forma umanamente percepibile.

    ITALECO S.R.L. non si assume alcuna responsabilità in caso di lesioni o di utilizzo illegale ed improprio dei dispositivi acquistati, derivanti da una mancata osservanza delle istruzioni, avvertenze, avvisi o indicazioni per il suo uso corretto.  

     

     

    TUTELA DEI DATI PERSONALI – RESPONSABILITÀ

    L’Utente/Cliente è l’esclusivo responsabile dell’utilizzo dell’APP e risponde direttamente di ogni danno o pregiudizio arrecato nei confronti della Società o alle terze parti  a seguito della violazione delle regole derivanti dai presenti Termini e Condizioni o dalle norme di legge, a seguito di un uso improprio, perdita, appropriazione indebita da parte di terzi.

    L’Utente, in qualità di utilizzatore dell’App, è l’unico responsabile dell’eventuale inserimento, utilizzo o condivisione di Dati Personali riferibili a soggetti terzi all’interno dell’applicazione.

    L’Utente garantisce di trattare tali dati nel rispetto dei principi di liceità, correttezza, trasparenza, minimizzazione e sicurezza previsti dal Regolamento (UE) 2016/679 (GDPR). In ogni caso, è esclusiva responsabilità dell’Utente garantire che ogni trattamento di dati personali sia effettuato nel pieno rispetto delle disposizioni previste dal Regolamento (UE) 2016/679 (GDPR).

    I dati che possono essere raccolti sono: Nome e cognome, recapito cellulare, data di nascita, indirizzo, e-mail, ed eventualmente una foto del cliente/utente. Tali dati possono costituire al limite le cd “schede cliente”. L’eventuale creazione di tali schede resta in ogni caso sotto l’esclusivo controllo dell’utente e non saranno in alcun modo accessibili da Italeco.

    La Società tenuto conto che non potrà avere alcun accesso a dati personali degli utilizzatori o dei clienti/utenti inseriti dall’utilizzatore, ai sensi e per gli effetti del Reg.to (UE) 2016/679 – GDPR, non è qualificabile come Titolare del trattamento di dati personali coinvolti nell’utilizzo delle App, e per l’effetto è estranea a tali trattamenti, non potendo in alcun modo accedere, visualizzare o trattare i dati dell’Utente. Pertanto, l’Utente si impegna a tenere indenne sin da ora la Società da ogni qualsivoglia responsabilità derivante dall’eventuale trattamento illecito o non autorizzato di dati personali.

    Non sono previste forme di pubblicità o comunicazione di dati a terzi, né si trasmettono dati all’esterno (compresi i dati di navigazione, cookie, ecc).

    La presente informativa può subire modifiche e/o integrazioni a seguito di eventuali successive modifiche e/o integrazioni normative, all’aggiornamento o erogazione di nuovi servizi ovvero ad intervenute innovazioni tecnologiche.

    WHO IS IT AIMED AT – RECIPIENTS/USERS

    The APPs are reserved for users who are at least 14 years old. Below this age threshold, users will be subject to the protection and supervision of their parents/guardians. Therefore, we invite those who are not yet in possession of this age not to download it, and those who are under the age of 18 to be assisted by their parents / guardians (hereinafter also only “user/s” if this eventuality occurs).

    PRODUCT FEATURES

    The main features of the Mic-Fi APPs are those of capturing photos and videos and for the MED PLUS / MEDICAL and BEAUTY APPs there is also the possibility of entering the name of the patient/client for cataloguing the photos.

    INSTALLATION – DOWNLOAD

    By downloading and installing the App on your device, you agree to these Terms of Service and Use as well as the privacy policy available at the following link https://mic-fi.it/elementor-6066/.

    The terms of use and Privacy Policy are available in their most up-to-date version.

    The APPs do not provide for forms of authentication/registration, but may collect personal data of users/customers/patients entered by the same so-called “users” of the APPs. Data that will be managed only by them. The Mic-Fi APPs work and are stored only locally on the user’s (chosen) device.

    In the event that users have made the purchase of a Mic-Fi APP, they are considered “Users/Consumers”, (hereinafter also referred to as “Customers” or “Buyers”) understood as natural persons who, in relation to the purchase of Products (microscopes), act for purposes unrelated to any entrepreneurial, commercial, craft or professional activity carried out.     The download of the APPs is available on the App Store – Apple and Google Play Store; the use of the APPs is reserved exclusively for the User, and may not be transferred to third parties. No forms of authentication are provided.

    We point out that the computer systems and software procedures used to operate the App acquire, during their normal operation, some data referable to the User whose transmission is implicit in the use of internet communication protocols, smartphones and devices used. This category of data includes, but is not limited to, geographic location, phone identity, user contacts, email, credit card information.

    However, the user can uninstall the downloaded App from their device at any time.

    FEATURES

    Once users have downloaded and installed the APP, it will be “locally” and therefore allocated directly on their device (tablet or smartphone). The APP is not supported by any remote server. Access must be via a “wifi” connection.

    The APP allows:

    • to take photos and record videos (in order to interface with the operating system of the device in which it is for storing photos and videos);

    • access to photos and videos on the device (in order to interface with the operating system for storing photos and videos);

    • access to the media/audio files folder on the device (in order to interface with the operating system to obtain the sound of taking the photo);

    • Access to geolocation (in order to be able to use the Mic-Fi tool)

    The APP is only usable by buyers/owners of a Mic-Fi device.

    USE – PROHIBITIONS AND CONSEQUENCES

    Since the use of the Apps is reserved only for users who are at least 14 years old, those who are not yet at least 14 years old are invited not to register. While minors between 14 and 18 years old will have to be assisted by their parents / guardians.

    The User is prohibited from using the App to carry out illegal actions. The Company reserves the right to take legal action to enforce its rights, should it ascertain the occurrence of the aforementioned events. Under no circumstances may the Customer alter, change, modify or adapt the APPs, nor any material made available by the Company.

    INTELLECTUAL PROPERTY

    Mic-Fi applications are subject to Copyright. All rights reserved. The Apps are protected by copyright laws and applicable international treaty provisions. The Apps may not be copied, decompiled, back-analysed, disassembled or reduced in any other way to humanly perceivable form.

    ITALECO S.R.L. assumes no responsibility in the event of injuries or illegal and improper use of the devices purchased, resulting from failure to follow the instructions, warnings, warnings or indications for its correct use.

    PROTECTION OF PERSONAL DATA – LIABILITY

    The User/Customer is solely responsible for the use of the APP and is directly liable for any damage or prejudice caused to the Company or third parties as a result of the violation of the rules deriving from these Terms and Conditions or from the law, as a result of misuse, loss, misappropriation by third parties.

    The User, as a user of the App, is solely responsible for any entry, use or sharing of Personal Data referable to third parties within the application.

    The User guarantees to process such data in compliance with the principles of lawfulness, fairness, transparency, minimization and security provided for by Regulation (EU) 2016/679 (GDPR). In any case, it is the sole responsibility of the User to ensure that any processing of personal data is carried out in full compliance with the provisions of Regulation (EU) 2016/679 (GDPR).

    The data that can be collected are: Name and surname, mobile phone number, date of birth, address, e-mail, and possibly a photo of the customer/user. These data can constitute at most the so-called “customer cards”. Any creation of these cards remains in any case under the exclusive control of the user and will not be accessible in any way by Italeco.

    The Company, taking into account that it may not have any access to the personal data of users or customers/users entered by the user, pursuant to and for the purposes of Reg.to (EU) 2016/679 – GDPR, cannot be qualified as a Data Controller of personal data involved in the use of the Apps, and as a result is extraneous to such processing, not being able to access in any way, to view or process your data. Therefore, the User undertakes to indemnify the Company from any liability arising from any unlawful or unauthorized processing of personal data.

    No forms of advertising or communication of data to third parties are envisaged, nor are external data transmitted (including browsing data, cookies, etc.).

    This information may be subject to changes and/or additions as a result of any subsequent amendments and/or additions to regulations, the updating or provision of new services or technological innovations.
